Sen. Rand Paul (R-Ky.) on Feb. 4 posed a question in the Senate that Chief Justice John Roberts refused to read out loud last week in the chamber during the impeachment trial of President Donald Trump.

FISA Court Reprimands FBI, But Makes a Notable Error Itself

The presiding judge of the Foreign Intelligence Surveillance Act (FISA) court, James Boasberg, issued a 19-page opinion and order on March 5, examining possible remedies for the material errors and omissions made by the FBI in its surveillance application on former Trump campaign foreign policy adviser Carter Page.

According to Boasberg, the “frequency and seriousness of these errors” in the Page case, combined with the sensitive nature and high-level review of the case by the Department of Justice (DOJ) and FBI “have called into question the reliability of the information proffered in other FBI applications.”Continue Reading

The Inconsistencies of Bill Browder & the Magnitsky Act

The Magnitsky Act, co-sponsored by Senators John McCain and Ben Cardiff, was signed into law by Obama in December 2012. The Act barred Russian officials suspected of human rights abuses from entering the United States, allowed for their U.S. assets to be frozen, and prohibited financial transactions with U.S. financial firms. The Act was expanded in 2016, allowing the U.S. Government to sanction foreign government officials anywhere in the world.

The Magnitsky Act came into being through the actions of Bill Browder, the CEO of Hermitage Capital Management. Hermitage Capital was formed in 1996 for the purpose of investing in Russia. The firm benefited from the wave of privatization that occurred, ultimately becoming one of the largest foreign investors in Russia.Continue Reading

Nine Days in May: The Quiet Struggle Between Rosenstein and McCabe

On Dec. 7, 2018, CNN published an article discussing events in the eight days following the May 9, 2017, firing of former FBI Director James Comey by President Donald Trump. Comey was fired after a recommendation letter written by Deputy Attorney General Rod Rosenstein, titled Restoring Public Confidence in the FBI, was delivered to the president.

The CNN article was a rehash of two prior articles from the New York Times and the Washington Post that claimed Rosenstein had discussed wiretapping Trump, though CNN did provide increased emphasis on the fact that then-Acting FBI Director Andrew McCabe opened an obstruction of justice investigation into Trump in the days following Comey’s firing.

Left out of the CNN article, however, are a number of critical facts, not the least of which is that much of what was being described came from memos written by McCabe, who is now the focus of a grand jury investigation.Continue Reading
